On November 8, 1972, appellant filed an application for a period of disability and disability insurance benefits under Sections 416(i) and 423 of the Social Security Act, 42 U.S.C. §Â§ 416(i) and 423 (hereinafter "the Act"). The application was denied both initially and upon reconsideration. Thereafter, appellant requested and was granted a hearing on the application before an Administrative Law Judge, which was held on December 10, 1973.On December 27, 1973, the Administrative Law Judge issued a decision finding that appellant was not entitled to disability insurance benefits, which finding was adopted by the Appeals Council of the Social Security Administration on June 3, 1976, as the final decision of the Secretary of Health, Education and Welfare (hereinafter "the Secretary").
